The following Terms and Conditions apply to America West Vacations (hereafter referred to as AWV) group packages.

Deposits: $100 per person amount plus $100.00 per package administration fee. All deposits must be called in via phone by 3:00pm MST on or before the hold date (MAXIMUM OF 2 WEEK HOLD) or the space will be canceled and the price will not be honored. Once deposit has been called in all MCO payments and signed contracts must be faxed to our office within 48 hours. Payment by check must be mailed within 48 hours. If we do not receive payment with the contract, even if it was called in, you are subject to cancellation. All packages require a $100.00 non-refundable administration fee, which will be applied to the final bill if the group travels.

Rates: All rates are per person, based on groups of ten or more rooms, and include all taxes except where noted. If the group drops below ten rooms then group benefits will not apply. If the group reduces to fewer than ten passengers traveling together, this agreement is void. Reservations depend on availability of flights and desired accommodations and are subject to confirmation. Rates do not apply to conventions, and individuals using these rates in connection with attending a convention may be assessed additional surcharges upon hotel check-in. Rates are valid only in conjunction with the America West Vacations package. Rates and schedules are subject to change without notice and rates are only guaranteed after receipt of full payment. No adjustments of package pricing will be made after a deposit has been made, nor shall any subsequent rate reduction be made retroactive.

Payment: For reservations made 55 days or more in advance, a deposit of $100 per person is required. Full payment is due no later than 55 days prior to departure. If the group is not paid in full by 45 days prior, the group is subject to full cancellation.

* Checks are not acceptable less than 60 days prior to departure. Checks must be mailed to our mailbox below. All groups that pay final payments within 45 days prior to departure will be subject to a 5% late payment fee of total gross due. Groups with late bookings, i.e. 59 days or less prior to departure may only pay by MCO or Credit Card. AWV reserves the right to re-bill in the event of any errors. MCO’s can be faxed in.

Rooming List: A complete typed rooming list must be received no later than 65 days prior to departure. If not typed and not legible AWV is not responsible for incorrect spelling of names. If names not received by 55 days prior, group is subject to cancellation at current penalties. Hotels are subject to closeouts at anytime. All names must be received within 24 hours of a notification of closeout. If names are not received, all rooms are subject to cancellation.
Changes: All changes are required to be submitted in writing. No changes will be allowed on the outbound flight. Changes made to existing reservations up to 31 days prior to departure will be processed at no fee. All changes made to existing reservations 30 - 14 days prior to departure are subject to a fee of $100 pp. No changes will be allowed on the outbound flight. Changes cannot be made 14 days or less prior to departure. AWV reserves the right to accept, decline, retain or remove any person as a member of the tour or package program at any time. Changes consist of name, or flight times. Changing dates will be considered a full cancellation and will follow the cancellation terms. Changes to passenger’s return flight are subject to availability and a $200.00 change fee. Hotel changes subject $100.00 per person. change fee 60 – 14 days. No hotel changes will be allowed if the hotel becomes a close out at any time. Changes in a package that involve a change in hotel room configuration are subject to rates in effect at the time changes are made. Payment for any rate increases will be required at the time of the change. Additional passenger added after deposit require a $100.00 per person deposit at time of request and is non refundable. No passengers can added to a group 65 days or less from travel. Changes, on printed documents, must be sent in to The Leisure Company via Federal Express only; no other carrier will deliver them to us.

Cancellations: Cancellations of packages booked directly through AWV must be phoned in to AWV and are effective at that time. Cancellations of packages may be subject to cancellation fees. Some packages are NON-REFUNDABLE. Cancellation of a person or persons in a package which involve a change in hotel room configuration are subject to rates in effect at the time cancellations are made. An Optional Cancellation/Change Waiver may be available with some packages; for details see below.

*Cancellations due to illness or death will follow the above terms. Additional fees or other charges imposed by third party vendors will be the responsibility of each passenger. No refunds will be provided until AWV has received documentation including airline tickets and vouchers, along with the proper medical documentation.
Refunds: Request for refunds or travel credit must be submitted in writing not later than 30 days after the departure date. The request must include the return of all issued documentation including airline tickets and vouchers for all ticketed individuals. No refunds or exchanges will be made for any unused package features. No refunds will be provided for lost, destroyed or stolen documents or tickets. All refunds are subject to the above provisions governing cancellations and changes, including applicable fees, and are further subject to any such fees or other charges imposed by third party vendors. Acceptance of a refund constitutes a waiver by the customer of all rights and remedies under applicable law other than the amount of the refund.

Comp Policy: Due to Vendor/Supplier agreements, complimentary fares are no longer available.

Gratuities: If a group is 10 or more rooms, baggage handling, porter gratuity at the hotel, and skycap at the airport upon arrival in Las Vegas are included. Skycap on the return, ground transportation and all other gratuities are the sole responsibility of the customer. Paid gratuities will vary for other destinations.

Exclusions: AWV rates do not include such things as meals, shows, tours not specifically included in the package, tips, telephone calls, liquor, taxes, laundry, or other items of personal nature not otherwise specified in the quoted rates or which are excluded from the package/tour price. Hotel age restrictions may also apply. All personal charges must be paid prior to departure from the hotel. A major credit card or cash deposit may be required upon check-in at the hotel. In the event of any disagreement with respect to such charges on a credit card the passenger will need to contact the hotel directly.

Special Requested Groups: If you need to have your group space requested, the hotel will not be reserved until deposit has been made.

Special Travel Requirements: The hotels and tourist facilities featured do not necessarily have the appropriate special services and equipment to accommodate persons with disabilities or special needs. Please advise AWV of any special request at time of booking and AWV will forward the request to the appropriate vendor. Fees and charge for special services may apply . Such request is treated as request only and cannot be guaranteed by AWV. AWV does not have control over seat assignments. All seats are assigned by the airline. Should seat assignments be requested, the request will be forwarded to the airline. Final seating assignments will me made by the airline at time of airport check in.

International Travel: A passport, Visa or specific types of proof of citizenship and a picture ID are the responsibility of the travelers. Additional documentation for children 17 or under traveling without both parents/legal guardians will be required. As requirements vary by country, please check with your Travel Agent or the Consulate for the destination country.

Responsibility: AWV is a tour operator, and an independent contractor, which makes arrangements with third party vendors for all tour and package services and accommodations other than air transportation. AWV is not an agent of the customer, or of other parties providing travel-related services. All travel documents are issued subject to the terms and conditions specified by such vendors. Neither AWV, nor any of its agents or employees shall be held liable for, and by accepting these documents customer waives any claim against all such parties for, (a) any loss of or damage to property or injury to any person caused by reason of any defect, negligence, or other wrongful act or omission of, or any failure of performance of any kind by, any other transportation company, vendor or supplier; (b) any inconvenience, loss of enjoyment, mental distress or other similar matter; (c) any delayed departure, missed connections, substitutions of accommodations, termination of service, or changes in fares and rates; and (d) any cancellation or double booking of reservations or ticket beyond the control of AWV, AWV will make reasonable efforts to arrange alternative services. AWV shall be held blameless and excused from this contract as a result of strike, lock-out, labor controversy, acts of God, airline disaster, acts of government, civil commotion, acts of terrorism or any other cause beyond the control of AWV. Claims on checked baggage are limited to $1,250 per person unless a higher value has been declared and applicable charges paid. In no event shall AWV be responsible for any amount other than the price paid by the customer for the tour or package. Each customer agrees that all disputes in any matters whatsoever arising in connections with the responsibility of AWV, Inc. under this agreement shall be construed and enforced in accordance with the laws of the state of Arizona, and each customer consents to jurisdiction before a court located in the state of Arizona, USA, to the exclusion of the courts in any other state or country.

Advisement By Travel Agents: Travel agents making a AWV group reservations warrant that each group member has been provided with and advised to carefully review a copy of the foregoing information and that each such person fully understands that he/she is subject to said requirements and policies. The foregoing Terms and Conditions are Subject to Change Without Notice. Payment of Deposits or Payment in Full Constitutes Final Acceptance of the Above Terms and Conditions.
